How Same-Sex Divorce Works in Orange County

Filing for divorce in California requires that at least one spouse have lived in California for a minimum of six months and in the filing county for at least three months. Orange County family law cases are primarily heard at the Lamoreaux Justice Center in Orange, the main family law courthouse within the Superior Court of California, County of Orange.

The process begins with a Petition for Dissolution of Marriage. From there, both parties exchange financial disclosures, then negotiate or litigate property, support, and custody issues before a judgment is entered. California requires a mandatory six-month waiting period before a divorce can be finalized, running from whichever comes first: the date the other spouse is served with the Petition and Summons, or the date the other spouse files their first response. Same-sex couples who were in a registered domestic partnership before marrying may need to address how that partnership is treated within or alongside the divorce proceedings. Couples who don’t yet meet the residency requirements can file for legal separation as an interim step, preserving certain rights while the residency period is completed.

Legal Challenges Unique to Same-Sex Divorce

Many same-sex couples built committed partnerships for years before they could legally marry. Courts focus on the legal marriage date to define community property, but earlier cohabitation and any agreements made during that period may still carry legal relevance. For couples who held a registered domestic partnership before marrying, community property rights may trace back to the partnership registration date rather than the marriage date itself.

Parentage is one of the more complex areas. When one parent isn’t biologically related to a child and no formal adoption was completed, California courts can still recognize legal parentage based on a demonstrated intent to parent and the extent of actual caregiving involvement. Establishing this requires documentation and a legal argument tailored to the specific facts of the relationship.

Assets with complicated histories also require attention:

Pre-marriage acquisition: Property acquired before the legal marriage date may qualify as separate property, but commingling with marital funds can complicate that analysis.
Cross-state or pre-recognition assets: Assets acquired across state lines or during periods when federal recognition didn’t exist may need careful tracing to determine community versus separate property status.
Tax considerations: Property transfers and spousal support treatment can differ based on the timeline of state and federal recognition of the marriage, and these implications are worth reviewing as part of the overall case strategy.
Privacy through mediation: Resolving issues through negotiation or mediation can limit the personal information that becomes part of a public court record, which is a meaningful consideration for some clients.
