Child Custody in a Contested Divorce

Divorce can be very emotional subject. Even when a marriage is ending on seemingly "good terms" there are still numerous issues which must be resolved before the court will grant a divorce. One of the most difficult aspects of a divorce involves the custody and support of any children from the marriage. If you and your spouse are unable to come to an agreement as to the custody of your child(ren), you may have concerns about how child custody issues will be decided in court.

In cases in which the two parents refuse to compromise on custody issues, the court will be forced to step in to resolve the matter. Initially, you the court will first encourage you and your spouse to try and come up with an amicable agreement through mediation or other process. If that does not lead to a resolution and an agreement, the court will order both of you to meet with a trained counselor, who will attempt to mediate and negotiate a plan which will benefit not only both of you, but your child(ren) as well, with the best interest of the children as the main concern. A court decision will not necessarily take into account any specific needs or requests you may have as a parent, but will be based upon what is believed to be best for the child or children.
